1. Who we are and what these Terms cover
These Terms are an agreement between you and IGOR PEREIRA RAMOS VIEIRA LTDA, a company established in Brazil ("Focusly", "we", or "us"). They govern the Focusly iPhone app, the Focusly Premium subscription, this website, and support.
Your use of the app is also subject to Apple's Licensed Application End User License Agreement and the App Store terms. If these Terms conflict with mandatory App Store rules, the App Store rules apply to that conflict.
2. The product
Focusly is a general-purpose focus app for iPhone. It includes focus sessions, Focus XP, levels, streaks, achievements, insights about distracting apps through Apple's Screen Time, and optional app shielding during sessions. It is not medical, psychological, or professional advice, it is not a parental-control product, and it does not guarantee any productivity or wellbeing result.
Focus XP, levels, and achievements are motivational features with no monetary value. They cannot be purchased, transferred, or exchanged.
3. Screen Time features
Screen Time features require your permission and a supported iOS version. They depend on Apple frameworks that may change, be delayed, or be unavailable, and usage detection is not guaranteed to be complete or exact. You can turn these features off at any time. Shielded apps are released when a session ends, when Focusly next opens after a session has expired, or when you choose Remove shields in Focusly Settings.
4. License
We grant you a limited, revocable, non-exclusive, non-transferable license to use Focusly on Apple devices you own or control, as permitted by the App Store terms. You may not reverse engineer Focusly except where applicable law expressly permits it, bypass its paid features, or use it to violate law or third-party rights.
5. Focusly Premium subscription
Focusly is free to start. Focusly Premium is an optional auto-renewable annual subscription, currently $29.99 per year in the United States with a 7-day free trial for eligible new subscribers. Prices vary by region; the App Store shows the final price, currency, and taxes before you confirm.
Payment is charged to your Apple Account when you confirm the purchase, or when the free trial ends. The subscription renews automatically at the same price and interval unless you cancel at least 24 hours before the end of the current period. Any unused part of a free trial ends when you purchase a subscription.
6. Managing and canceling
Manage or cancel Focusly Premium in your Apple Account subscriptions (Settings → your name → Subscriptions). Cancellation stops the next renewal; access continues until the end of the paid period. Deleting the app does not cancel the subscription.
7. Refunds and consumer rights
Apple processes App Store purchases, so refund requests are made to Apple at reportaproblem.apple.com and decided under Apple's policies. We cannot issue refunds for App Store purchases directly.
Mandatory consumer rights remain unchanged, including any statutory withdrawal right that applies to you. Where local law gives you stronger rights, those rights prevail.
8. Your data
You own your content. Focus data is stored on your iPhone and is not backed up by Focusly. Our handling of personal data is described in the Privacy Policy.
9. Updates, availability, and support
We may fix, improve, add, remove, or discontinue features for security, compatibility, legal, or product reasons. We do not promise uninterrupted or error-free operation or compatibility with every future iOS release.
Support is provided on a reasonable-efforts basis through support@focusly.sh.
10. Intellectual property and feedback
Focusly, its software, design, illustrations, website, name, and branding belong to IGOR PEREIRA RAMOS VIEIRA LTDA or its licensors. These Terms transfer no ownership to you.
If you voluntarily send ideas or feedback, you allow us to use them without restriction or payment, provided we do not identify you publicly without permission.
11. Disclaimers
To the maximum extent permitted by law, Focusly is provided "as is" and "as available", without implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. This section does not exclude any warranty or consumer guarantee that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; or loss of profits, productivity, data, or business.
Where liability may legally be limited, our total liability arising from Focusly will not exceed the amount you paid for Focusly Premium during the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability or remedies that cannot be limited under applicable law, including mandatory consumer rights.
13. Governing law and disputes
These Terms are governed by the laws of Brazil, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it directly.
If you are a consumer, this clause does not take away any mandatory right to bring a claim in your place of residence or under the consumer laws that protect you.
14. Changes and general terms
We may update these Terms for legal, security, or product changes. The effective date will be updated, and material changes will be communicated when reasonably possible. If one provision is unenforceable, the remaining provisions continue to apply. A delay in enforcing a provision is not a waiver.
